Default Fourth Amendment Violations in SLO

This event took place in April 2008 but has just come to the attention of the pubic after Daniel Blackburn put together a video report on his web site at HOME PAGE | KCCN.tv on July 16, 2010. You can watch the video in one segment using Quicktime or watch it in 3 parts on YouTube (linked at the bottom of the page).

It's spread throughout many forums, etc. on the Internet in just a few days. One Sheriff candidate already has said he'd have the FBI investigate the matter if elected Sheriff: Cortez speaks out against deputies transgressions - Cal Coast News

Mr. Blackburn was interviewed on a local radio show from 5-7pm Tuesday night and, reportedly, the District Attorney telephoned Mr. Hart later that night to report that all but one of his remaining guns in possession by the Sheriff would be returned as soon as a judge signs the release. Coincidence?

I've thought it a bit strange how I hear some folks say they don't trust law enforcement officers. Unfortunately, a few bad guys earn the rest a bad reputation.

Harvey, unfortunately this is not an isolated incident. Not even close. And the few you speak of are not a few at all. This event will be covered up and forgotten about in a short amount of time. The problem of our government's disregard for the constitution is growing exponentially. And fears of repercussions for challenging such violations are keeping people quiet. As of yet, the Bill of rights has been reduced to a Bill of Privileges. If we don't act now, It will soon be gone all together. Everything our founding fathers fought for will be lost. People celebrate Independence day every year without a second thought. They celebrate with complete ignorance to the fact that our government is becoming the very entity that we declared independence from in the first place. The only hope this country has for reform is to get a candidate from either the Tea party or Constitution party in office by the next election.

Seth, thanks, I hadn't heard of the Constitution Party.

I didn't mean a "few" literally and should have been clearer about that, but guess I feared being labeled an extreme paranoid citizen, etc. I do know many law enforcement officers who are good folks, including the Sheriff Deputy that has had to come to my farm several times in the past few years due to thefts, trespassers refusing to leave, etc.

I don't think this particular case is going to get ignored as it's had a tremendous amount of following in the past several days and some action has already taken place. Some public events are also being planned to increase awareness of this matter.

Thanks Harvey, I'm not trying to condemn cops. I agree with you, there are plenty of good cops out there. I'm just eluding to the fact that this type of situation is all too common. And it rarely results in needed policy changes.

Harvey, thanks for bringing this case to our attention. Very frightening. However, to then jump off into a denounciation of both parties and the need for right wing 'Tea Parties' is a tad much, in my humble (member of the Democratic Party) experience. This is a problem with local law enforcement and their lack of proper training in the limitations imposed by the 4th Amendment. As that alone, it is a frightening experience.

The party system never made much sense to me, and I never could choose one over the other(Democrat or Republican). It's extremism of the parties that causes instability. I just think that the right wing parties need a little more acknowledgment to restore the balance. It's the fundamental ideas behind these two right wing parties that interests me. In my mind, it just makes sense.

Howard, many of our rights are being challenged by both of the major parties. I happen to be of the opinion that the party of your preference is a bit more dangerous at the present time. Too much government "of" the people.

I don't happen to have any involvement in the Tea Party but will admit that many of their actions appear interesting to me, especially if you ignore some of the unfounded claims by mainstream media which feels their close times to particular parties may be challenged.

Well, the bipolar party system surely is interesting (no, it really isn't). Back before 1989 we had a bipolar system here too. What you have is pretty much the same.

Here it was the most ruthless, stupidest, arrogant people (Communists), who desired power over other people and could achieve that only thru the most lame, uneducated, very wide part of the population.
In your case, the scenario is very similar, but the "free" people make a selection of what is offered to them. Your rulers (let's call them according to the marxist theory "Capitalists") have chosen the slow, more covert, less ruthless form of getting to power.

However what has to (inevitebly) come with an authoritarian regime is slavery (no matter whether you're in chains, have mortgages...) and dictat of power. And just like any dictatorship, it will dissolve, when the people learn to fight it from the inside.

None of these models (Capi or Comu) is good and should be used today (because each of them finds a way to "torcher" a substantial amount of people in the population). But for all people to understand, it has to mutate into a dictatorship. After all nations in this world have known despotism, we can and necessarily will reform the existing models, eliminate many of their parts and base the system on cooperation, empathy and what makes us human, not on money, greed, power and other things that can drive people all over the planet kill other people or eliminate other people for being born somewhere else/having some ideas...

No. Banana socialism would be this: Govt comes, seizes all bananas from Californian and Floridians, gives it to all people from New York, Michigan and New Yersey and then, if they are magically lucky to produce some bananas, the govt takes the bananas and divides them into the population.
Of course, the plan would be fulfilled on 124%.

And nobody would actually have any banana, cause they would rot in the transit.
